THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. In some jurisdictions, limitations of liability are not permitted. In such jurisdictions, some of the foregoing limitations may not apply to You.
Termination/Access Restriction
Texas Indian Restaurants reserves the right, in its sole discretion, to terminate your access to the Site and Services and the related services or any portion thereof at any time, without notice.
Governing Law/Dispute Resolution
To the maximum extent permitted by law, this agreement is governed by the laws of the State of Washington and you hereby consent to the exclusive jurisdiction and venue of courts in Washington in all disputes arising out of or relating to the use of the Site. Use of the Site and Services is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this Section. Texas Indian Restaurants’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Texas Indian Restaurants’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or Services or information provided to or gathered by Texas Indian Restaurants with respect to such use.
Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under these Terms shall be finally settled in accordance with the Comprehensive Arbitration Rules of the Judicial Arbitration and Mediation Service, Inc. (“JAMS”) by a single arbitrator appointed in accordance with such Rules. The arbitration shall take place in King County, Washington, in the English language and the arbitral decision may be enforced in any court in any jurisdiction. The prevailing party in any action or proceeding to enforce these Terms shall be entitled to costs and attorneys’ fees.
No Joint Venture
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Texas Indian Restaurants as a result of this agreement or use of the Site or Services.
Changes to Terms
Texas Indian Restaurants reserves the right, in its sole discretion, to change the Terms under which the Site and Services are offered, and such modification(s) will be effective immediately upon being posted on our Site (www.texasindianrestaurants.com). The most current version of the Terms will supersede all previous versions. Texas Indian Restaurants encourages you to periodically review the Terms to stay informed of our updates.
